The Section 138 cheque-bounce notice

For a dishonoured cheque, Section 138 of the NI Act requires the payee to send a written demand to the drawer within 30 days of learning of the dishonour, calling upon them to pay the cheque amount within 15 days of receiving the notice. Only if the drawer fails to pay within those 15 days does the offence become complete, after which a complaint can be filed.
